NTPA Code of Ethics and Conduct<\/h1>\n

The NTPA educator recognizes the magnitude of the responsibility inherent in the teaching process. The desire for the respect and confidence of one’s colleagues, students, parents, and members of the community provides the incentive to attain and maintain the highest possible degree of ethical conduct. The NTPA Code of Ethics and Conduct indicates the aspiration of all NTPA members and member organizations and provides standards by which conduct is judged.<\/p>\n

The Code is designed to identify the ethical responsibilities of NTPA members (hereafter referred to as \u201cMembers\u201d), and serves as a guide for decision-making for NTPA educators. Intrinsic to the ethical standards outlined in the Code are the values of trust and fair-mindedness; honoring human dignity, emotional well-being, and cognitive development; respect for spiritual and cultural values; and integrity in professional commitments and responsibilities.<\/p>\n

The Code is meant to provide guidance and to be adhered to in a manner consistent with good ethical judgment, professional conduct, and avoidance of even the appearance of impropriety. All Members are required to pledge adherence to these principles when admitted to membership and annually with membership renewal.<\/p>\n

I. COMPETENCE<\/h2>\n

Members will work honestly, legally, and ethically within the purview of their expertise and will continually strive to improve their practice.<\/p>\n

    \n
  1. Members practice within the boundaries of their competence, which derives from relevant education, training, acquired knowledge, and professional experience. They will claim special competencies only if such competencies are demonstrable. In cases with elements outside their competence, they consult with or refer clients to appropriate colleagues.<\/li>\n
  2. Members continually update their knowledge of industry best practices, both in breadth and depth, through such activities as attending professional conferences, continuing education, and professional reading and research.<\/li>\n
  3. Members are familiar with and adhere to state and federal laws relevant to their practices.<\/li>\n<\/ol>\n

    II. POTENTIAL CONFLICTS OF INTEREST<\/h2>\n

    Members will actively work to avoid potential conflicts of interest and communicate clearly to prevent the appearance of any conflict of interest.<\/p>\n

      \n
    1. Sometimes, a Member may have multiple roles or relationships with a School\/Program that could create or appear to create a conflict of interest. Such roles could include but are not limited to owning a School\/Program or serving as a consultant, board member, or employee of a School\/Program. Members are expected to avoid multiple relationships that could reasonably and foreseeably give rise to actual or perceived conflicts of interest, interfere with the ability of the Member to provide objective service, embarrass the student or family, or compromise the confidence or trust basic to the client relationship.<\/li>\n
    2. A School employee may not tutor any of their current classroom students for remuneration.<\/li>\n
    3. If the Member performs tutoring or test preparation work as part of their contracted teaching work or as a stipend in addition to their teaching contract, they should not recommend themselves exclusively for additional outside tutoring services or underperform in their contracted duties to funnel students to their private business.<\/li>\n
    4. In no case should the tutor or employee offer incentives or coercion to the student or family to choose their company over competitors.<\/li>\n
    5. When a Member provides services to a client in their capacity as a member of another licensed profession or professional organization, they shall act according to that profession or organization’s ethical code and guidelines regarding multiple relationships.<\/li>\n
    6. Members shall avoid conflicts of interest and the appearance of conflicts by being forthcoming with clients and the NTPA.<\/li>\n<\/ol>\n

      III. RELATIONSHIPS WITH STUDENTS AND FAMILIES<\/h2>\n

      Members will maintain honest, sensitive, respectful, and confidential relationships with client families and strive to fulfill their students\u2019 educational needs.<\/p>\n

        \n
      1. Members treat students and their families with respect and decency, with sensitivity to their special strengths, values, and needs.<\/li>\n
          \n
        1. Members are aware of and sensitive to cultural, individual, and role differences and do not discriminate or condone discrimination based on age, race, gender (including pregnancy, childbirth, or related medical conditions), gender identity or expression, sexual orientation, marital status, military service or veteran status, religion, creed, ethnicity, physical or mental disability, national origin, native language, citizenship, socioeconomic status, or any other characteristic protected by applicable federal, national, state, or local laws where the NTPA operates.<\/li>\n<\/ol>\n
        2. Members shall not engage in unethical or criminal behavior on behalf of a student or family.<\/li>\n
        3. A Member\u2019s primary obligation is to assess, make recommendations for, and meet the student’s educational needs.<\/li>\n
        4. Members are clear and forthright about the nature and scope of their services.<\/li>\n
            \n
          1. Members must disclose all fees and financial arrangements before services begin.<\/li>\n
          2. Members shall honor and fulfill all service agreements unless exceptional circumstances necessitate termination upon reasonable notice.<\/li>\n
          3. Members inform clients of their confidentiality policies.<\/li>\n<\/ol>\n
          4. Members will keep all client and student information confidential.<\/li>\n
              \n
            1. Members maintain confidentiality of records, notes, and client information and disclose confidential information only with written consent and on a need-to-know basis.<\/li>\n
            2. Members provide substantially consistent information to the student, family members, and all other professionals involved in the educational process.<\/li>\n<\/ol>\n<\/ol>\n

              IV. PROFESSIONAL INTEGRITY<\/h2>\n

              Members will practice honestly and with the highest level of professionalism.<\/p>\n

                \n
              1. Members shall maintain the highest levels of ethical and legal conduct while teaching, tutoring, and counseling students. Members will scrupulously avoid even the hint of impropriety.<\/li>\n
              2. Members will only use legally acquired test preparation materials.<\/li>\n
              3. Members will ensure that instruction with minors is conducted in spaces or settings with the explicit approval of these students\u2019 parents\/guardians.<\/li>\n
              4. Members will communicate directly with minors only through approved channels with the explicit consent of these students\u2019 parents\/guardians.<\/li>\n
              5. Members will not engage in romantic relationships or entanglements with active students, regardless of age.<\/li>\n
              6. Members will support the highest levels of academic integrity. Under no circumstances will Members participate in plagiarism or other forms of cheating, including but not limited to writing papers, doing homework, or providing answers to client assignments.<\/li>\n
              7. Members will work to minimize anxiety surrounding the college admissions process.<\/li>\n
              8. When asked, Members must fully disclose any financial referral or affiliate relationships.<\/li>\n
              9. All Members who have referral or affiliate relationships must include this public-facing disclosure statement on websites and contracts:<\/li>\n
                  \n
                1. We have partnerships and\/or affiliate relationships with other professional service providers that include financial remuneration. Families are invited to ask for details about these partnerships.<\/li>\n<\/ol>\n
                2. Members will fulfill all written service agreements with clients, collaborators, and vendors unless exceptional circumstances necessitate termination upon reasonable notice.<\/li>\n
                3. Members are responsible for resolving the ethics violations of their staff members.<\/li>\n
                4. Members will behave with the highest level of professionalism at NTPA-sponsored events or when acting as, or perceived as, representatives of the NTPA.<\/li>\n<\/ol>\n

                  V. ADVERTISING AND OTHER PUBLIC STATEMENTS<\/h2>\n

                  Members will speak honestly, respectfully, and kindly in public.<\/p>\n

                    \n
                  1. In dealings with the public, including paid or unpaid advertising, Members will represent themselves honestly, avoiding misrepresentation of what they state or refrain from stating.<\/li>\n
                  2. Members will not make disparaging public remarks about colleagues, either verbally or in their print or electronic communications.<\/li>\n
                  3. In recognition of how an individual\u2019s actions can reflect on larger organizations and industries, Members will adhere to the NTPA Social Media Policy<\/a>.<\/li>\n
                  4. Members are familiar with and strictly adhere to the NTPA Logo Usage Guidelines.<\/li>\n<\/ol>\n

                    VI. OBSERVANCE AND ACTIONS<\/h2>\n

                    Members will hold one another accountable for their actions.<\/p>\n

                      \n
                    1. Violating this Code of Ethics is grounds for suspension or expulsion from the National Test Preparation Association.<\/li>\n
                    2. All observed ethical violations should be brought to the attention of the NTPA Ethics Committee.<\/a><\/li>\n
                    3. The consequence of a Member\u2019s first ethical violation will vary based on severity, from a warning to immediate expulsion.<\/li>\n
                    4. A Member\u2019s second ethical violation within a twelve-month span will result in immediate expulsion from NTPA.<\/li>\n<\/ol>\n

                      The remedies specified by the NTPA for violating any provision of this Code shall be exclusive, and no such provision shall be enforceable in any form other than the one specifically designated by the NTPA.<\/em><\/p>\n

                      The NTPA Code of Ethics and Conduct is a living document that will be updated and amended periodically according to the evolving needs of our Members, industry, and organization.<\/p>\n
